Negligent Lifeguarding
Swimming pool accidents happen every day in the United States. In public and private pools, the most common situation with drowning or near drowning accidents is negligent supervision. If the accident was due to Lifeguarding negligence while on duty, they can be held liable. Lifeguards are paid professionals that are required to follow a strict standard of care to their clients/customers. If any of the following conditions occured, the lifeguard could be held liable:
- Inattentive Supervision: The lifeguard on duty is providing inadequate supervision such as leaving the premises, talking with co-workers, looking at their cell phone or falls asleep.
- Slow reactivity to an Emergency: Lifeguards are trained to react fast in an emergency situation. Seconds matter in a drowning and a slow reaction time could cause extreme harm or death.
- Inadequate Training: In an emergency, the failure to recall training, or fails to act appropriately can cause serious harm to a swimmer.
- Improper CPR: All lifeguards should have proper CPR certification, and should have monthly trainings to keep up to date on theproper usage of CPR. The inability to do so can result in serious injuries and death.
